That’s how an FBI sting operation might go down, and those with no criminal record are especially vulnerable. Let’s call the foregoing conjecture, but on this you can depend. The FBI specialists are trained to deceive, to successfully lie to the most difficult to persuade; accomplished, suspicious, career criminals. They have the time and the budget to make it work and the stuff you see on TV doesn’t scratch the surface.37 (part 13)
The reason the real extent of a sting operation is never voluntarily revealed in the courtroom is due to the probability of an entrapment defense. If it could be proved that the idea for committing the crime was subtlety developed over time by a sting operative (s), that the mark was largely persuaded by undercover team members, and that the mark would probably not have committed the manufactured crime if he had not been manipulated by government agents, he may have an entrapment defense. Even if the mark had committed a few similar crimes on a smaller scale, if the crime the government agents manipulated him to commit was on a much grander scale, entrapment might be argued.
Certainly, if the back-end of the sting operation included operatives that were trained to psychologically manipulate a mark’s emotions, and were responsible for significantly altering his state of mind, a jury would be interested in hearing an entrapment defense. Here, it is interesting to note that Davis, although he pled guilty in court, reportedly told the court that the FBI “devised a scheme of entrapment and inducement targeting (him) under the pretext of friendship, and deception of lies.”38 He may not even have a clue.
In an Anti-Defamation League Special Report released in August, 2011 titled: “The Lawless Ones: The Resurgence of the Sovereign Citizen Movement,” they list among law enforcement officers who have gone over to the dark side an FBI agent, also in Nevada, who joined the movement. Was the agent formally an undercover operative who played the role so well he bought into the character? Interestingly, the ADL reports that the agent plead guilty to tax evasion in May, 2009 after another FBI three year investigation into—money laundering.39
That would be only two months before Sovereign Citizen national leader Samuel Davis was also indicted in Nevada on the same charge.
Coincident alone does not necessarily prove concurrent steams of deception. There are, however disturbing tributaries that are stepped over almost routinely by most without giving a second thought to the bleeding liberty passing beneath their feet.
